Just to play Devil's advocate for a moment.........

I'll just have to assume that all of you "that is theft" folks have never ever in the past copied a friend's album onto cassette or burned a copy of one of their cds for yourself. What's the difference???

the diffence is that your friend bought it or you bought a copy you let your friend copy - ie you've bought bought commerical releases whereas this is a site putting it all out there to any and everyone for free - damn right it's wrong! Especially to the most generous band that ever existed.

Morally, I think there's very little difference (between copying a friend's CD, and downloading an illegally published copy of it). In either case, one gets something without paying for it.

Legally, I believe that the copyright law permits one copy of a protected work for personal research or use of works that are not easily available for sale. So any published recordings that are out of print could be fairly copied by a person for their own private use. Hence, photocopiers in libraries.

Like you, I have bigger fish to fry and luckily am in a position to buy the recordings I want (at a modest pace...). But to distribute copies of protected works for free to the whole Web is a blatant copyright violation that seemed, to me, to warrant calling out.

shit - never got as far as the salmon. had a late lunch out with the Mrs and was too full for a real supper. lunch was good though - very tender baked chicked with melted goat cheese, red peppers, parsley, and warm lemon butter sauce - along with a medley of pan seared veggies.

went well with all the illegal music I downloaded today. (oops - let the cat out of the bag on that one - damn!!)

I just checked: I have 5 songs on my hard drive, and one of those was an Amazon download that I paid a good .99 cents for...

From About.com:
When it comes to digital music and the law, a lot of people are confused about what they can and can’t do. Here is a list of CD dos and don’ts that will keep you safe.

Dos:

* Ripping CDs: Only rip original CDs that you legitimately own - borrowing an original CD off someone doesn't count.

* Digital Music Files: You can transfer digital music files to your own personal MP3 player providing those files have been ripped directly from a CD that you legitimately own.

* Copying a CD: Only copy original CDs that you legitimately own; you can burn ONE copy only for your own personal use.

Don’ts:

* Downloading ripped CD tracks: Never download copyrighted music from non-authorized Internet web sites that provide you with ripped CD tracks.

* Using file sharing programs (P2P): Ensure that if you do have a file sharing program installed on your computer that your legitimate CD rips are never made available to others on the Internet. This constitutes copyright infringement and you risk being sued by the RIAA.

* Copying a CD: Never make copies of CDs that you legitimately own in the belief that it is OK to give to your friends and family.

* Respecting copyright: Don't assume that just because there isn't a copyright notice on a CD or it's packaging that it is free to copy and distribute.

* Borrowing a CD: Borrowing an original CD off someone to make a copy for yourself or others is illegal.

* Digital music files: Don't copy digital music files from someone else’s MP3 player or computer, even if they own the original CD.

Hypocrites. Does this come from the same group that uses a "backdoor" to "acquire" GD soundboards?

"* Copying a CD: Never make copies of CDs that you legitimately own in the belief that it is OK to give to your friends and family."

These may, or may not be YOUR do's and don't.......but......

Wow. I guess I'm a hardened criminal. I've done this hundreds of times. As a result, my friends and family have been turned-on to countless bands and performances. They've purchased thousands of dollars of CD's and tickets. And they've told 2 friends, who told 2 friends and so on and so on and so on.........

Sorry. I feel that I, High Flow, have helped advance the cause of true art in music. I've certainly done more than the major labels. AND, I've done it out of love, not profit. Please, please, please try and convince me that my heroes who make this music would sue me for such an act!

and
never forget

as soon as the "illegally" procured music files are downloaded to your computer, you burn them immediately to disc, and never, ever, ever save the files on your laptop or externals. (just to be on the safer side)

hell, it's free, so who cares if the disc scratches down the road and you lose it - the files will probably still be out there, and the damn disc only cost you about 25 cents anyways.

hypothetically speaking of course

(now where in the world did i put ALL the commercially released cd's sent to me by upstanding members of this forum?? hell, none of them were even GD related. imagine that - i am part of an underground illicit stolen music organization.)

The problem here is that this website charges money, before you can download somebody else's copyrighted music. They use a Paypal account to handles these illegal transfers.

Nobody is prosecuted for making copies of their CDs and giving them away for nothing. Grateful Dead Productions doesn't give a shit either...

you are right Finster - it looks to me that these were bought releases and then uploaded to fileshare sites - very little difference in me buying a copy and then sending it to two or three of you guys. very very little difference.

That's insulting.
All my mixed tapes were made from FM recordings from Casey Kasem's American Top 40.

Yes!! With the annoying DJ cut-in at the end of the song! That was devotion to music. Sittin' by the radio hand on the dial. Soon as you hear it, pump up the volume. I did that.

And if you were really good you did a manual turn backwards on the tape between songs to make the transitions between songs that much more abrupt.

Seriously though, I never really did any mix tape making and once I started really collecting music, I became aware of the whole "ripping off" the artist thing. I taped (recorded) a lot of shows and copied the recordings for a bunch of folks, but I always bought the official/commercial releases and encouraged others to do so. Never copied a commercial release for myself. If I heard a good album at someone's house, I went out and bought it. May have gotten some filler on the end of a tape from a commercial release, but always eventually bought the record/CD. In fact, I have tried to always give away at least one copy of each show I taped as a kind of payback for the privilege of being able to make the tape in the first place.
Sorry. I just get bent out of shape by the folks who always want it for free, like they're getting over on someone by copying (or downloading as it is today) rather than buying. If it's for sale, then buy it. Simple.
